Monday Ménage: Edition Judging Judges Who Shouldn’t Be Judging

Over the objections of the United States Department of Justice, District Judge Aileen Cannon, nominated by Trump in 2020, granted a request by former President Donald Trump’s legal team to appoint a special master to review documents seized by the FBI during a search of his Florida home last month as part of the investigation of Trump for allegedly holding unsecured classified material in his residence at Mar-a-Lago.

The response from legal experts who understand the rule of law has been as clear as one would expect…

 

Weissmann. Katyal. Rangappa.

Weissmann was an Assistant United States Attorney from 1991 to 2002, where he prosecuted high-profile Organized Crime cases.

In 2002, President George W. Bush appointed Weissman to be the deputy director and then director of the Federal Bureau of Investigation’s Enron Task Force. Weissman also served as the General Counsel of the Federal Bureau of Investigation from 2011 to 2013.

Starting in 2015 he became the chief of the criminal fraud section of the U.S. Department of Justice. In June 2017, he was appointed to a management role on the 2017 special counsel team headed by Robert Mueller. To assume that position, Weissmann took a leave from his Department of Justice post.

 

Even though this Judge’s Order appointing a special master won’t stop the very serious Trump stolen docs investigation, having been the decider of whether DOJ should appeal various cases in the past, I think DOJ has to appeal here. Katyal served as Acting Solicitor General of the United States from May 2010 until June 2011. Previously, Katyal served as an attorney in the Solicitor General’s office, and as Principal Deputy Solicitor General in the U.S. Justice Department. Katyal has argued more U.S. Supreme Court cases than any other minority lawyer in American history
