SEDITION. PERIOD!

Former Army Lt. General, former National Security Advisor in Trump Administration, admitted criminal (guilty of twice lying to the FBI), fired by Trump, pardoned by Trump, and, good buddy of Vladimir Putin, Michael Flynn, is calling on Trump to declare martial law, suspend the constitution and have the military hold a new election.

Other un-American Trump sycophants, including retired Air Force Lt. General and 16-year Fox News military analyst Thomas McInerney, have called for this and similar actions.

No doubt Flynn is aware that his words/actions amount to Sedition under the Uniform Code of Military Justice – however, in the case of McInerney, as questions remain as to whether or not his elevator goes all the way to the top floor any more, he just might be bat-shit crazy enough to be uaware; after all, he was a one-time leader in the birther movement.

It is here noteworthy that McInerney in 2018 was fired from Fox ‘after he claimed that the late Republican Senator John McCain provided information to the North Vietnamese while he was a prisoner of war’.

And, in an interview with Military Times, McInerney proclaimed with certainty that “President Trump won in a landslide and the Dems left so many footprints that this TREASON must be stopped!!!. This will be the last free election we have and I predicted it on 2 Nov on the Steve Bannon Show!”

Well, then, that seems legit… .

But, when asked by Military Times for proof to back up his claims, McInerney “forwarded a lengthy conspiracy newsletter that, among other things, described Rudy Giuliani’s recent conduct as ‘shocking and professional’ and discussed whether Trump should declare martial law to overturn the election results”.

Nevertheless, the UCMJ makes clear what constitutes sedition:

U.S. Code § 894 – Art. 94. Mutiny or Sedition

a) Any person subject to this chapter who –

      1. with intent to usurp or override lawful military authority, refuses, in concert with any other person, to obey orders or otherwise do his duty or creates any violence or disturbance is guilty of mutiny;
      2. with intent to cause the overthrow or destruction of lawful civil authority, creates, in concert with any other person, revolt, violence, or other disturbance against that authority is guilty of sedition; fails to do his utmost to prevent and suppress a mutiny or sedition being committed in his presence, or fails to take all reasonable means to inform his superior commissioned officer or commanding officer of a mutiny or sedition which he knows or has reason to believe is taking place, is guilty of a failure to suppress or report a mutiny or sedition.

b) A person who is found guilty of attempted mutiny, mutiny, sedition, or failure to suppress or report a mutiny or sedition shall be punished by death or such other punishment as a court-martial may direct.

 

NOTE: All branches of the military do not have legal authority to call for martial law. And the government says that applies to ex-military officers as well.
